Partner Chris Strang Argues the Commonwealth Has a Duty to Verify Payment Bonds on Public Construction Projects

In a case of first impression, the court in Kapiloff’s Glass, Inc. et.al. v. University of Massachusetts (UMASS), et.al., MICV2014-08766 will consider whether the public awarding authority has a duty under M.G.L. c. 149, §29 to ensure that the payment bond provided by the general contractor on public construction projects is valid.

On the University of Massachusetts at Lowell Dry Lab Renovations construction project, several subcontractors brought claims on the general contractor’s payment bond, for nonpayment by the general contractor. The subcontractors obtained favorable judgments, but the payment bond surety failed to pay.  The payment bond proved to be fake, and the surety was not registered to do business with the Massachusetts Division of Insurance.

Strang Scott brought claims against the University of Massachusetts on behalf of four of the subcontractors for the awarding authority’s failure to ensure that the payment bond provided at the time of bid was valid. The University of Massachusetts filed a motion to dismiss, arguing that it had no duty to ensure the authenticity of either the payment bond itself, or the surety issuing it. Strang Scott opposed the motion, arguing that the statute imposes such a duty, without which security on public projects would not exist for the subcontractors that rely upon the payment bonds.

In November, the Middlesex Superior Court heard oral arguments on the dispute, and a decision is expected in the near future. The impact of that decision will be far reaching, as it will ultimately determine whether subcontractors submitting bids on public construction projects in Massachusetts can rely upon the legitimacy of the general contractor’s payment bond.

StrangScott Partners Selected as recipients of 2015 Super Lawyer Awards

Both the Super Lawyer list and Rising Star lists are the result of an intensive, multi-step selection process involving nominations, peer review, and independent research. Only 5% of eligible attorneys are selected as Super Lawyers, while only 2.5% of eligible attorneys are selected as Rising Stars.

Christopher Strang Receives Young Lawyer’s Chair from BU

On Saturday, September 26, 2015, partner Chris Strang received a 2015 Silver Shingle Award (Young Lawyer’s Chair) from his alma mater, Boston University.  Boston University School of Law is honored each year to present several outstanding alumni and friends with Silver Shingle Alumni Awards. These awards, a tradition at the School of Law since 1967, recognize notable contributions to the legal profession, leadership within the community, unfailing service to the School of Law, and superlative contributions to society.

Congratulations to Warner Youth Sports Association on Successful Golf Classic

School Guard Glass Making News Again

The glass is nearly impenetrable, as you can see in the video demonstration recently shown on the local Fox News affiliate. This is becoming a popular product to specify in public buildings, particularly schools, for its ability to deter potential intruders.

Christopher Strang Appointed to Chair BU Law’s Job Placement Task Force

Boston University School of Law’s Career Development Office appointed Christopher Strang to serve as co-chair of its Job Placement Task Force for a second year. Started last year, the Task Force is comprised of some of BU Law’s most distinguished alumni throughout the country. They are responsible for providing advice to the Career Development Office on current hiring needs in the profession as well as developing programs to assist students and recent graduates find permanent placement.
